Legal Services

Mediation

Mediation is a confidential process where the mediator serves as a third-party neutral assisting the parties in reaching an agreement. Mediation can be voluntary or court ordered. The mediator does not make decisions or report to the presiding judge, but instead helps the parties to focus the issues and reach a resolution that they are in charge of crafting. Mediation is typically scheduled for an initial three-hour session with follow-up sessions if needed.

Domestic Conciliation

Conciliation is a dispute resolution process where the conciliator serves as a third-party neutral, but the process is not confidential. The conciliator first assists the parties with focusing the issues and reaching a resolution. If the parties do not reach a resolution the conciliator reports to the court. The scope of the report is determined by the presiding judge in advance and may include recommendations based on an investigation of the facts and circumstances of the case. Conciliation is typically a 60–90-day process.

Parenting Coordination

Parent coordinators are appointed by the court to assist parents with implementing their parenting plan, improving communication, and focusing on the best interests and needs of their child or children. Parent coordinators may be appointed for up to 24 months at a time and can make changes to parenting plans that are not substantial or do not change legal or physical custody. Parent coordination is appropriate when there has been:

  • Persistent conflict between the parents
  • Ineffective parental problem-solving or communication
  • A parent has a history of substance abuse
  • A history of domestic violence
  • Concerns about the metal health of a parent
  • A child has special needs
  • The court deems parent coordination is otherwise appropriate.
